Who we are

This Privacy Policy explains how Cucalorus Film Foundation (“Cucalorus,” “we,” “us,” or “our”) collects, uses, and shares information when you use cucalorus.org and related pages, forms, or services (the “Site”). What we collect

We collect information in three ways:

1. Information you provide

• Contact details submitted via forms (e.g., name, email, phone, message).  
• Information used to purchase tickets or passes through our ticketing partners (see “Third-party services”).  
• Information included with festival submissions (e.g., via FilmFreeway).  
• Donation details you submit to our donation processor(s) (we do not receive full payment card numbers).  

2. Information collected automatically

• Basic device and usage data (IP address, browser type, pages viewed, timestamps).
• Cookies or similar technologies that help operate the Site, remember preferences, and understand aggregate usage. You can control cookies through your browser settings; see “Your choices.”

3. Information from partners

• Limited transactional data from ticketing, submission, and donation platforms (e.g., purchase or submission metadata) so we can administer programs, screenings, schedules, donor records, and customer service.

How we use information

We use information to:

• Operate and improve the Site and our programs (including festival operations and year-round screenings);
• Process ticketing, registrations, submissions, and donations;
• Communicate with you (transactional notices, program updates, marketing—where permitted);
• Protect security, prevent fraud, and comply with legal obligations.

Our legal bases (where applicable, e.g., EEA/UK) include consent, contract, legitimate interests (running a nonprofit arts organization and events), and legal obligations (e.g., tax/recordkeeping).

Third-party services we rely on

We work with reputable service providers to run the festival and the Site. When you interact with these providers, their privacy policies apply to those interactions:

• Ticketing & passes: We use Eventive for festival passes and tickets (and coordinate with Thalian Hall, which uses the Spektrix platform for Thalian Hall screenings). When you buy tickets there, you are interacting directly with those platforms.  
• Submissions: We accept festival submissions via FilmFreeway. Your submission and account are handled by FilmFreeway under its own terms and privacy policy.  
• Donations: We accept donations through pages linked from our Site that process payments via Square (and related donation pages hosted by/for Cucalorus). Payment details are handled by those providers.  

We may also use standard vendors for web hosting, email communications, analytics, file storage, and similar infrastructure services. They are contractually limited to using data to provide services to us.

When we share information

We share information only as needed to:

• Work with service providers listed above;
• Comply with law, enforce policies, or protect rights, safety, or property;
• Complete a transaction you initiate (e.g., coordinating with venue/ticketing partners to fulfill a purchase).  

We do not sell your personal information, and we do not knowingly “share” it for cross-context behavioral advertising as defined by California law.

Data retention

We keep personal information only as long as necessary for the purposes described here—such as running events, honoring opt-out requests, and meeting legal, tax, or accounting requirements (e.g., retaining donation records).

• Marketing emails: You can unsubscribe from promotional emails at any time using the link in the message.
• Cookies: Most browsers let you control or block cookies; doing so may affect Site functionality.
• Ticketing/submission/donation accounts: Manage your information directly with the platforms you used (Eventive, Thalian/Spektrix, FilmFreeway, Square).

Your rights

Depending on where you live, you may have rights to access, correct, delete, or receive a copy of your personal information, and to object to or restrict certain processing.

• California (CCPA/CPRA): You may request access, deletion, and information about our data practices. We do not sell personal information.
• EEA/UK (GDPR): You may request access/erasure/portability and object to certain processing. Where processing is based on consent, you can withdraw it at any time.

Children’s privacy

Our Site and programs are not directed to children under 13, and we do not knowingly collect personal information from children under 13 without appropriate consent as required by law.
